Terms of Service

1. Definitions

• “causalIT” or “the Service”: the web analytics platform available at https://causalit.fr, including its application, tag, SDKs, API and documentation.
• “We”, “us”: FI-DATA, a simplified joint-stock company (SAS) under French law with a share capital of €1,500, registered with the Auch Trade and Companies Register under number 900 033 622, whose registered office is at 80 rue Jean Jaurès, 32500 Fleurance, France.
• “You”, “Customer”: the person or legal entity that creates an account; a person acting for an entity warrants that they are entitled to bind it.
• “Organisation”: the workspace that holds sites, members and the subscription.
• “Site”: a hostname you register in order to measure its audience.
• “Customer Data”: the configuration you enter and the audience events collected for your Sites.

2. Acceptance and changes

Creating an account constitutes acceptance of these terms. We may amend them; material changes are notified by e-mail or in the application at least 30 days before they take effect. If you disagree, you may close your account before that date; continued use after it constitutes acceptance.

3. Account

• You must be at least 18, or act for a legal entity, and provide accurate information.
• Your credentials are personal. You are responsible for every action taken through your account and must tell us immediately at contact@causalit.fr if you suspect unauthorised use.
• Some features (inviting team members, share links, custom domains, billing) require a verified e-mail address.
• Members you invite into your Organisation act under your responsibility.

4. The Service

causalIT measures the audience of your Sites without cookies, explains the variations it detects and states the strength of its evidence. We provide the application, the tag, the SDKs and a REST API; you integrate them on your own Sites. Features evolve: we may add, change or withdraw features, and we give reasonable notice before withdrawing a feature that materially reduces the Service.

The Service is provided on a best-effort basis, without a guaranteed availability level. We aim for continuity, perform maintenance with notice whenever possible, and back up the account database daily. Scheduled jobs (alerts, reports, retention purge) run on our schedule and may be delayed.

5. Plans, quotas and prices

Prices are in euros, excluding VAT; VAT is added at the applicable rate on the invoice. An annual billing option may be offered at the price shown at checkout.

Quotas are soft: above the included events we keep ingesting up to a 20% margin and notify you; beyond that margin, excess events are dropped until the next month or an upgrade. We may change the Free plan at any time with notice in the application.

6. Billing, renewal and cancellation

• Paid plans are billed in advance, monthly or annually, through Stripe. Card details are entered on Stripe's pages and never reach us.
• Subscriptions renew automatically for the same period until cancelled. You can cancel or change plan at any time from the billing page; a cancellation takes effect at the end of the paid period, which remains due, and the Organisation then returns to the Free plan and its limits. Changing plan mid-period is prorated by Stripe.
• Amounts paid are not refunded for the current period, except where the law requires it.
• Failed payment: Stripe retries; if payment still fails, the subscription is cancelled and the Organisation returns to the Free plan.
• We may change prices with at least 30 days' notice by e-mail; the new price applies from the next renewal.
• If you are a consumer within the meaning of the French Consumer Code, you have a 14-day right of withdrawal from subscribing. By asking for immediate access to a paid plan you agree that the Service starts at once and that, if you withdraw, you owe the part of the period already used.

7. Your obligations

• You warrant that you own, or are authorised to measure, every Site you register, and that you have a lawful basis to do so under the regulations that apply to you.
• You undertake not to send us personal data in page paths, custom properties or event names: causalIT is built to measure without identifying anyone, and you must keep it that way.
• If you use the identified mode of the backend SDK, you are the controller of the identifiers you send: you must have a legal basis, inform your users and send only irreversibly hashed values.
• You will mention audience measurement by causalIT in your own privacy policy.
• You will not attempt to access other customers' data or our systems, circumvent quotas or security measures, overload the API, reverse-engineer the Service, resell it without our written agreement, or use it for unlawful purposes.

8. Customer Data and intellectual property

Customer Data remains yours. You grant us the licence strictly needed to host, process and display it in order to provide the Service, including the statistics shown to you and to the people you share them with. We may use aggregated, non-identifying usage metrics to operate and improve the Service.

The Service — software, tag, SDKs, design, wordmark, documentation — is our property or that of our licensors. We grant you a personal, non-exclusive, non-transferable right to use it for the term of the contract. Feedback you send us may be used freely.

9. Confidentiality and personal data

Each party keeps the other's non-public information confidential. For the audience data of your Sites, we act as your processor under the Data Processing Agreement, which forms part of these terms. For your account data, see the Privacy Policy.

10. Suspension and termination

• You may delete your account at any time from the Account page. If you are the sole owner of an Organisation that still has other members, transfer ownership first.
• We may suspend or terminate an account, after notice whenever possible, in case of breach of these terms, non-payment, a legal requirement, or a risk to the Service or to third parties.
• On termination, your Organisation, Sites and their audience data are deleted as described in the Privacy Policy. Export what you need beforehand: CSV exports and the account data export are available in the application.

11. Warranties and liability

The Service is provided “as is”. We do not warrant that it is error-free, uninterrupted or fit for a particular purpose. Audience figures and explanations are estimates produced by a measurement method that deliberately identifies nobody; they can differ from other tools and must not be your only basis for a decision.

To the extent permitted by law, our total liability for all claims arising from the contract is limited to the amounts you paid us in the 12 months preceding the event, and we are not liable for indirect losses (lost profit, data you failed to export, business interruption). Nothing limits liability that cannot be limited by law, in particular towards consumers.

12. General

• Force majeure suspends the obligations it affects for its duration.
• If a clause is held invalid, the rest remains in force.
• We may transfer the contract to a successor of the business, with notice.
• These terms are governed by French law. For professionals, disputes are submitted to the competent courts of the place of our registered office. Consumers may bring a dispute before the court of their domicile and may use a consumer mediator free of charge; write to contact@causalit.fr first so that we can try to resolve the matter, and to obtain the mediator's details.
